NJ Legionella Regulations - Bill S2032 (Approved On 9-12-24)
KUDOS to New Jersey for implementing the most robust legislation (S2188) to prevent and control cases of Legionnaires disease. New Jersey’s new Senate Bill 2188 was signed into law by the governor on September 12, 2024 and is effective immediately!

ANSWER: There Are 3 Main categories that your building may fall into: 

#1: This law requires all below noted buildings to develop a domestic water (drinking water) management program and must include the non-potable water system device(s), if applicable:

* A residential high-rise structure with 6 or more floors and 1 or more centralized potable water-heater systems. (Excludes residential properties with four or fewer units)

*A building with one or more centralized potable water-heater systems shared by 25 or more housing units for transient use, including, not but limited to, a hotel or motel

*A residential building with a centralized potable water-heater system that is shared by 25 or more housing units, which serves as subsidized housing designated for individuals who are 62 years of age or older or who have a disability, or is designated as senior housing and is subject to the provisions of P.L.1986, c.103 (C.52:27D-330 et seq.)

* A federal, state, county, or privately owned or operated correctional facility with one or more centralized potable hot water systems

* Any building that has been determined by the Department of Health (DOH) or a local health officer to have been associated with an outbreak of Legionnaires’ disease

* A building containing a whirlpool, spa, and/or pool
* A building containing a cooling tower (open circuit, closed circuit and/or an evaporative condenser) that provides cooling or refrigeration
* A building with an indoor ornamental fountain, mister, atomizer, air washer, humidifier, or other non-potable water system or device that releases water aerosols inside or outside of the building

* A building containing a whirlpool, spa, and/or pool
* A building containing a cooling tower (open circuit, closed circuit and/or an evaporative condenser) that provides cooling or refrigeration
* A building with an indoor ornamental fountain, mister, atomizer, air washer, humidifier, or other non-potable water system or device that releases water aerosols inside or outside of the building

SUPPLEMENTAL INFORMATION FOR BUILDING OWNERS

* May be required to test for Legionella if suspected as a source; results must be reported to the DOH.
* Must notify potentially exposed individuals, in multiple languages if necessary
* A written public notice must be posted on-site indicating the implementation of the water management program
* Must maintain documentation of procedures and records for at least five years, accessible to relevant authorities
